Welcome to the Jefferson Institute. The following lists the Jefferson Institute’s terms of use and terms of service.

You may use the Jefferson Institute’s website, www.jeffersoninst.org, for any lawful purpose, subject to the conditions in this User Agreement.

The Jefferson Institute allows users to register an account and provide comments on www.jeffersoninst.org. If you register an account, you own all of the content and information you post on www.jeffersoninst.org. For content that is covered by intellectual property rights, you specifically grant the Jefferson Institute a non-exclusive, transferable, perpetual, sub-licensable, paid-up, royalty-free, worldwide license to copy, modify, distribute, publish, display, or perform any of the content that you post on www.jeffersoninst.org.

You may not submit or transmit through www.jeffersoninst.org any material that violates or infringes the rights of others including, without limitation, patent, trademark, trade secret, copyright, publicity or other proprietary rights.

You may also not submit or transmit through www.jeffersoninst.org any material that contains viruses or any other computer code, files or programs that interrupt, destroy or limit the functionality of any computer software or hardware, or otherwise permit the unauthorized use of a computer or computer network.

YOU EXPRESSLY UNDERSTAND AND AGREE THAT:

YOUR USE OF THE SERVICES IS AT YOUR SOLE RISK. THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. THE JEFFERSON INSTITUTE, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND ITS AGENTS EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

THE JEFFERSON INSTITUTE, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND ITS AGENTS MAKE NO WARRANTY THAT: (I) THE SERVICES WILL MEET YOUR REQUIREMENTS; (II) THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE; (III) THE SERVICES WILL BE ACCURATE OR RELIABLE; AND (IV) ANY ERRORS IN THE SOFTWARE USED TO PROVIDE THE SERVICES WILL BE CORRECTED.

ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE SERVICES IS ACCESSED AT YOUR OWN DISCRETION AND RISK, AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF ANY SUCH MATERIAL.

NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM USE OF THE SERVICES SHALL CREATE ANY WARRANTY WHATSOVER.

LIMITATION OF LIABILITY

YOU EXPRESSLY UNDERSTAND AND AGREE THAT THE JEFFERSON INSTITUTE, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND ITS AGENTS SHALL NOT BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF THE JEFFERSON INSTITUTE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM: (I) THE USE OR THE INABILITY TO USE THE SERVICES; (II) THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES RESULTING FROM ANY GOODS, DATA, INFORMATION OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH OR FROM THE USE OF THE SERVICES; (III) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSION OR DATA; (IV) STATEMENTS OR CONDUCT OF ANY THIRD PARTY USING THE SERVICES; OR (V) ANY OTHER MATTER RELATING TO THE SERVICES.

EXCLUSIONS AND LIMITATIONS

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. ACCORDINGLY, SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

Indemnification

Upon a request by the Jefferson Institute, you agree to defend, indemnify, and hold harmless the Jefferson Institute, its directors, officers, employees, and agents from all liabilities, claims, and expenses, including attorney’s fees that arise from your use or misuse of www.jeffersoninst.org. The Jefferson Institute reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate with the Jefferson Institute in asserting any available defenses.

Choice of Law

You agree that the laws of the District of Columbia govern this contract and any claim or dispute that you may have against us, without regard to the District of Columbia’s conflict of laws rules, and that the United Nations Convention on Contracts for the International Sale of Goods shall have no applicability. You further agree that any disputes or claims that you may have against us will be resolved by a court located in the District of Columbia and you agree and submit to the exercise of personal jurisdiction of such courts for the purpose of litigating any such claim or action.

PLEASE NOTE THAT BY AGREEING TO THESE TERMS OF USE, YOU ARE: (1) WAIVING CLAIMS THAT YOU MIGHT OTHERWISE HAVE AGAINST US BASED ON THE LAWS OF OTHER JURISDICTIONS, INCLUDING YOUR OWN; (2) IRREVOCABLY CONSENTING TO THE EXCLUSIVE JURISDICTION OF, AND VENUE IN, COURTS IN THE DISTRICT OF COLUMBIA OVER ANY DISPUTES OR CLAIMS YOU HAVE WITH US; AND (3) SUBMITTING YOURSELF TO THE PERSONAL JURISDICTION OF COURTS LOCATED IN THE DISTRICT OF COLUMBIA FOR THE PURPOSE OF RESOLVING ANY SUCH DISPUTES OR CLAIMS.

Integration

This User Agreement and any supplemental changes or policies constitute the entire agreement between you and the Jefferson Institute and supersede all previous written or oral agreements.

Severability

If any part of this User Agreement is held invalid or unenforceable, that portion shall be construed in a manner consistent with applicable law to reflect, as nearly as possible, the original intentions of the parties, and the remaining portions shall remain in full force and effect.

Privacy Policy

The Jefferson Institute respects the privacy of every individual who visits our website or sends us e-mail. Therefore, we comply with applicable data privacy legislation in regard to processing personal data. This Privacy Statement describes how the Thomas Jefferson Institute for the Study of World Politics (Jefferson Institute) uses and protects personally identifiable information. This Privacy Statement, together with our Website Terms of Use, constitute the entire agreement between you and the Jefferson Institute relating to the publicly accessible portions of our website. Where permissible under applicable law, by your use of our website, you consent to be governed by this Privacy Statement.

We reserve the right to change, modify, add, or remove portions of this Privacy Statement, at any time. Any such modification would not result in the reduction of your privacy or rights and would only serve to enhance the Jefferson Institute’s Privacy statement and security. As stated below, at any time, you have the right to request access to any information that the Jefferson Institute stores about you and, at any time, you have the right to request to be forgotten and have all information that the Jefferson Institute stores about you deleted. We highly recommend that you review this Privacy Statement and the Website Terms of Use from time to time to ensure that you are familiar with the most recent version. The examples contained in this Privacy Statement are illustrations; they are not intended to be exclusive.

Personal data

You have the opportunity, via our website or other means, to provide us with personal information about you and your interests. This information may include, but is not limited to, your name, mailing address, e-mail address, and interests.

If you choose to share any personal data with us via our website or via e-mail, we will store it and use that information for internal purposes; such as to send certificates of completion, e-newsletters you have requested, or event invitations. We use industry standard practices to review data quality and confirm that the information we have for you is up-to-date.

We also store data that you voluntarily provide during Jefferson Institute events in order to keep you informed of other events of a similar nature.

At any time you may contact us if you no longer want us to use your personal information for these purposes.

Donations

The Jefferson Institute is a 501c3 non-profit non-partisan organization. If you choose to make a donation to the Jefferson Institute, we request certain personally identifiable information from you. We encrypt this information using Secure Sockets Layer technology (SSL) and digital certificates. 

We use this information for billing purposes. If we have trouble processing the donation, we will use this information to contact you.

Jefferson Institute will not share or sell a donor's personal information with anyone else, nor send donor mailings on behalf of other organizations.

Transfer of the personal data to other Jefferson Institute offices

Your personal data may be transferred for the above stated purposes to other Jefferson Institute offices, whether located within the European Union or elsewhere, including the United States, if you have specifically provided your consent.

Sharing of the personal data with other organizations

For network communities, such as the ADL Global Partnership, the Jefferson Institute will share your information with other members of these communities (including any successors of the Jefferson Institute or other community members).

This information will not be shared outside of these communities. To avoid people receiving multiple invitations to the same co-sponsored event, the Jefferson Institute reserves the right to share your first name, last name, and employer with partner organizations for the purpose of de-duplicating the final invitation list. Except as described in this Privacy Statement, we will not share your phone number, e-mail address, or any other contact information.

The Jefferson Institute will not share your information with any third party unless we have your explicit consent.

The Jefferson Institute will not sell, rent, loan, trade, or lease any personal information collected online or offline. 

Security

The Jefferson Institute uses secure data networks that are protected by firewall and password protection systems that are consistent with industry standards. The Jefferson Institute’s security and privacy policies are periodically reviewed and enhanced as necessary. Only authorized individuals have access to the information provided by Jefferson Institute contacts. The Jefferson Institute’s database is located in the United States.

Should a data breach occur that affects your personal information, the Jefferson Institute will take appropriate action within 72 hours of discovering the breach.

“Cookies”

You may visit our website anonymously. Except as described in this Privacy Statement, we do not collect identification data of our visitors.

We do, however, use cookies (small computer files that stay on your computer and let us know when and how often you visit our site) to keep and track general information about website usage. Cookies do not identify the individual user, just the computer used.

Cookies and other similar technology can make it easier for you to use the website during future visits. Cookies only record which areas of the site have been visited by the computer in question, and for how long. This information allows the Jefferson Institute to understand how our website is being used, which helps with planning future website activity.

Log Files

Like most standard Web site servers, the Jefferson Institute uses log files. The Jefferson Institute collects and stores only the following information about you: the name of the domain from which you access the Internet (for example, aol.com, if you are connecting from an America Online account, or princeton.edu if you are connecting from Princeton University’s domain), the date and time you access the site, and the Internet address of the website from which you linked to the Jefferson Institute site. The Jefferson Institute uses this information to measure the number of visitors to the different sections of the site, and to make the site more useful to visitors. Upon request, the Jefferson Institute is required by law to disclose this and other information records to you.

Throughout our web pages, we provide links to third-party servers and websites which may contain information of interest to our users. We take no responsibility (and shall have no liability) for, and exercise no control over, the organizations, views, or accuracy of the information contained on third-party servers and/or sites. Legal Disclaimer

Though we take industry standard measures and other efforts to preserve user privacy, the Jefferson Institute may need to disclose personal information (including personally identifiable information) when required by law wherein we have a good-faith belief that such action is necessary to comply with a current judicial proceeding, a court order or legal process, and/or in connection with a verified request relating to criminal investigation or alleged illegal activity.

Opt-Out or Change Your Contact Information

When you receive e-mails from the Jefferson Institute you have the opportunity to opt-out of receiving future communications. You may choose to receive only specific communications or none at all. You may also update your contact information previously provided to us via an online form. If you unsubscribe from future e-mails, we will keep your e-mail address on file to ensure we no longer send you e-mails. We will only contact you according to the preferences you specify.

We will not share, sell, or trade your personal information with any entity not part of the organization, nor send donor listings on behalf of other organizations.

All information shall be kept absolutely confidential unless given consent to.

Access to information, data rectification, and erasure

You have at any time the right of access, modification, correction, and removal of your data collected in our database. You can request this by contacting the Jefferson Institute by e-mail or in writing at the address mentioned below. Upon request, the Jefferson Institute will delete all of the information stored about you within 30 days of the request.

How you can access and update your information

The accuracy of your information is important to us. Anytime you receive an e-mail from us, you may click the link at the bottom of the e-mail ‘Manage My Subscriptions’ and an e-mail will be sent to the e-mail we have on file for you with a link to update your information. Legal Basis for Processing

Where required by the EU General Data Protection with Regulation 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (“GDPR”), we will only collect and process personal information about you where we have a legal basis. Examples of legal bases include consent (where you have given consent), contract (where processing is necessary for entering into or the performance of a contract with you), and “legitimate interests”.

You may withdraw your consent at any time, but that will not affect the lawfulness of the processing of your personal data prior to such withdrawal. We may process your personal information for the purposes of our legitimate interests, provided that such processing does not outweigh your rights and freedoms. - Send marketing materials about our programs;

If you wish to stop receiving e-mails from the Jefferson Institute, you may withdraw your consent. Any withdrawal of consent does not affect the lawfulness of processing your personal data based on consent before its withdrawal.

Third Party Service Providers working on our behalf

When we use third party service providers, we disclose only the personal information that is necessary to deliver the service and we have a contract in place that requires them to keep your information secure and not to use it for their own direct marketing purposes. Please be reassured that we will not release your information to third parties beyond the Jefferson Institute network for them to use for their own direct marketing purposes, unless you have requested us to do so, or we are required to do so by law, for example, by a court order or for the purposes of prevention of fraud or other crime.

E-mail Tracking     

When you receive an e-mail from the Jefferson Institute, to include event invitations, newsletters, or other communication, we may collect information about you in the following ways if you open or click on links in that e-mail:

  • Opening e-mails: If you open the e-mail, we log that activity on our database. 

  • Clicking on link View as web page: If you click on the "view as a web page" link, a tracking code is passed in the link so that the web page will be personalized the same way the e-mail is personalized.

  • Clicking on links to web pages: If you click on any web link in the e-mail, we pass a tracking code in the link to the web page which we use to log that activity.

  • Unsubscribing: If you unsubscribe from receiving e-mails, we will log this information in our database and we will continue to store your personal data on a “suppression list" so as to record your preference and not send you anymore e-mails.

  • RSVPs for Events: In our event invitations and confirmations, we provide buttons to allow you to accept, decline, and cancel registration for that event. Clicking on these buttons will pass a tracking code so we can record your choice in our database to help us manage the event.

No cookies are used for e-mail tracking. The above tracking does not apply to e-mails sent to you from personal Jefferson Institute e-mail accounts.

Retention Period

We retain the information we collect from you when we have an ongoing legitimate business need to do so. We will also retain your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

When we no longer need to process your personal data for the purposes set out in this Policy, we will delete your personal data from our systems.

Right to Complain

If you are in the European Economic Area (EEA), you have the right to complain to a data protection authority about our collection and use of your personal data. Automated Decision-making

We do not make use of automated decision-making. Copyright Infringement Policy

The following two sections describe the procedure for providing a DMCA Notification and DMCA Counter-Notification.

DMCA Notification

The Jefferson Institute respects the intellectual property rights of others. If you believe in good faith that your work has been copied in a manner that infringes your copyright, or that your intellectual property rights have been otherwise violated, please provide the following information, as required by Digital Millennium Copyright Act (17 U.S.C. Section 512(c)(3)(A)), to the Jefferson Institute’s Designated Copyright Agent:

(i) A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

(ii) Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.

(iii) Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit the service provider to locate the material.

(iv) Information reasonably sufficient to permit the service provider to contact the complaining party, such as an address, telephone number, and, if available, an electronic mail address at which the complaining party may be contacted.

(v) A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.

(vi) A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

If, after contributing changes, enhancements, or other copyrightable code to the Jefferson Institute, you receive a notification from the Jefferson Institute that a third party has made a charge of copyright infringement against you, you may provide a counter-notification.

If you provide a counter-notification, it must include the following information, per the Digital Millennium Copyright Act (17 U.S.C. Section 512(g)(3)):

(A) A physical or electronic signature of the subscriber.

(B) Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.

(C) A statement under penalty of perjury that the subscriber has a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.

(D) The subscriber's name, address, and telephone number, and a statement that the subscriber consents to the jurisdiction of Federal District Court for the judicial district in which the address is located, or if the subscriber's address is outside of the United States, for any judicial district in which the service provider may be found, and that the subscriber will accept service of process from the person who provided notification under subsection (c)(1)(C) or an agent of such person.
